Nintendo has not given any respite to those involved in the piracy of Switch and its games. Proof of this is that the company has just filed lawsuits against 2 individuals involved in the sale, distribution, and promotion of illegal software and hardware.
According to the details, the company sued Ryan Daly, who operates the store Modded Hardware, and James “Archbox” Williams, a moderator of a Reddit forum on piracy. Both individuals are in trouble, as they will have to face Nintendo's lawyers.
Nintendo files new lawsuits to curb Switch piracy
We know that Nintendo sent a cease and desist letter to Daly in March, asking him to stop selling modified Switch consoles. The Modded Hardware seller agreed to do so in March; however, he did not stop his sales.
In response, Nintendo did not hesitate to sue him in the Seattle courts, United States. Now, the seller is accused of 6 counts, including copyright infringement. The company seeks damages and the complete shutdown of his services. Additionally, it will confiscate all modified hardware and software.
“Defendant not only offers the hardware and firmware to create and play pirated games, but he also provides his customers with copies of pirated Nintendo games,” the company stated in the lawsuit.
As for Williams, we know that Nintendo accuses him of overseeing, operating, and promoting several piracy stores. He is accused of offering "massive" libraries of pirated Switch games. He is also targeted for being a moderator of a forum on the hybrid console's piracy, where he answered questions to guide people interested in modifying their consoles.
“Since 2019, Defendant has posted thousands of comments and messages to the SwitchPirates Reddit Group. Defendant’s posts have included, by way of example, messages directing users to the Pirate Shops […] and offering technical advice and encouragement to other users about how to use the Pirate Shops, how to download and install Circumvention Software, and how to play pirated copies of Nintendo Switch games,” the company stated.
Nintendo also wants financial compensation from Williams for the damages. It also seeks to shut down all the stores he operates and his social media related to his illegal activities. For now, there is no more information about these cases.
